Question of the day

What is the role of a notary in verifying a signer’s identity?

The role of a notary in verifying a signer’s identity primarily involves ensuring that the individual is indeed who they claim to be, typically through the use of valid identification. This is a critical responsibility of a notary, as it helps to prevent fraud and maintains the integrity of the notarization process. A notary must confirm that the identification presented is current and contains a photograph of the signer, along with other identifying details, which further supports the verification process. In contrast, collecting personal information from the signer or conducting a background check goes beyond the standard duties of a notary. The notary does not engage in gathering additional personal data beyond what is necessary for identification and notarization. Also, while witnessing the signing of a document is an important task of a notary, it is secondary to the necessity of first verifying the identity of the signer. Establishing that the signer is indeed the individual they present themselves as is the foundation on which all other responsibilities, including witnessing the signing, are built.

Illinois notary requirements changed on January 1, 2024. If you've come across a guide describing 25 to 30 questions and an 80% passing score, set it aside, that's the old format.

Questions 50
Passing score 85%
Bond $5,000, 4-year term
Commission 4 years (resident), 1 year (non-resident)
Recordbook Required since June 5, 2023

Fifty questions at 85% means missing more than seven puts you below the line, there's very little room for a handful of careless mistakes to cost you the whole thing. The broader question count also means broader topic coverage: notary powers and duties, completing notarial certificates correctly, identifying signers, recordbook requirements, and the legal consequences of misconduct.

Before any of that, Illinois requires you to be at least 18, an Illinois resident for 30 days (or a bordering-state resident employed in Illinois for 30 days), a US citizen or permanent resident alien, free of felony convictions, able to read and write English, and clear of any commission suspension or revocation in the past decade.

A jump from roughly 30 questions and 80% to 50 questions and 85% is a meaningfully higher bar. It rewards timed, full-length practice over reviewing a short question set, and it leaves less margin for skipping the recordbook material just because it's a newer addition to the law.

Our practice questions are built to the current 50-question, 85% format, not the version that stopped being accurate in 2024.

While I’m still studying, I find the question format in Examzify very engaging. The flashcards allow for targeted review of weak spots, which is helpful. Randomized questions do keep things fresh, but I do sometimes wish for a bit more context on certain topics. Overall, I think I’m on the right track!
